The term "GESTRAL" used below refers to GESTRAL SAS and includes any natural or legal person associated with the products or services that GESTRAL offers or provides, directly or indirectly, in person or by any other means. This includes, but is not limited to, products or services offered under the name of (or by) "Nicolas Raute" in the same way.

Thank you for visiting this website (NicoRaute.com or NicolasRaute.com) and any other site or social media profile such as FACEBOOK, INSTAGRAM, TIKTOK, YOUTUBE, PINTEREST, CLUBHOUSE, and TWITTER, hereinafter “Sites” of GESTRAL. To avoid confusion, we clarify that the Instagram profile named GESTRAL is not ours. By accessing or using the Sites and/or GESTRAL's services, you, as a user, accept the Terms of GESTRAL as an unequivocal conduct, which will be governed, interpreted, and applied according to the applicable laws of the jurisdiction where GESTRAL operates. Any disputes shall be resolved through arbitration in Bogotá, Colombia, in accordance with the rules of the Bogotá Chamber of Commerce. Additionally, you accept that you have the right, authority, or competent capacity to accept these Terms or have the authorization of your Legal Representative and/or Guardian to do so—otherwise, you are prohibited from using the Sites and GESTRAL’s services. GESTRAL refers to any natural or legal person associated with the service or services that GESTRAL offers or provides, in person or by any other means. The Sites are created to publish content for GESTRAL’s target audiences. They function as digital sites where GESTRAL is described, among other things but not limited to, its services, products, prices, offers, news, policies, communication channels, and as a portal for acquiring clients and suppliers.

Content and Information

The Sites are considered the property of GESTRAL where applicable, and for better functionality and performance, they are controlled and operated in conjunction with third parties through their services. These third parties may include GOOGLE LLC (Google Workspace services), HUBSPOT INC, GOPLUS (GO HIGH LEVEL version), XPERIENCIFY.COM, HOTMART, PAYPAL, FACEBOOK, INSTAGRAM, TIKTOK, YOUTUBE, PINTEREST, CLUBHOUSE, and TWITTER. By using services that integrate third-party platforms (e.g., Google, PayPal, Facebook), you acknowledge that their respective terms of service and privacy policies may apply. Please review their terms separately before using these integrated services. GESTRAL is not responsible for service availability, content, or the acquisition, safeguarding, or use of information subject to these third parties. The material contained in the Sites is the property of GESTRAL or third parties who have directly or indirectly authorized its use and may be protected under Copyright Law. The GESTRAL brand, the information, and distinctive signs of the brands and businesses reflected on this page are the exclusive property of GESTRAL or third parties who have authorized their inclusion. Any unauthorized use is prohibited. Violation of these rights will be pursued civilly and, where applicable, criminally, in accordance with National Laws and applicable International Treaties.GESTRAL is not responsible if the content registered here by us or third parties is deemed inappropriate for other regions of the world and ensures that its information will not be directed or intended for immoral or illegal purposes. By using the Sites, the user acknowledges and accepts all the Terms established herein, which will take effect from the moment of their publication and/or update.

Payments

Services (as a medium, not a result) and/or products requested from GESTRAL must be paid for in advance unless otherwise agreed in advance and in writing. One-on-one services can be rescheduled and/or canceled without penalty, provided that written notification (including calendar invitation cancellations sent by GESTRAL) is given at least 24 hours before the scheduled service time. Applicants are responsible for any applicable state or local taxes related to their purchases, unless GESTRAL is required by law to collect and remit such taxes. Colombian VAT (IVA) is included in all prices, where applicable. GESTRAL will comply with applicable U.S. tax regulations, including sales tax collection where legally mandated.

Personal Data Protection

The user accepts and acknowledges the data protection policy available at https://nicoraute.com/privacy, which includes consultation and claim procedures that allow them to exercise their rights to access, knowledge, consultation, rectification, updating, and deletion of data according to HÁBEAS DATA. Residents of the European Economic Area (EEA) have rights under the General Data Protection Regulation (GDPR), including the right to access, correct, or delete personal data and to object to processing. If you are a resident of California, you have rights under the California Consumer Privacy Act (CCPA), including the right to request access to your data, deletion of your personal data, and to opt out of data sharing for targeted advertising. User Commitments

The user is obligated to use the content diligently, correctly, lawfully, and, in particular, commits not to:

(a) Use the content against the law, morality, good customs, or public order.

(b) Any improper use of GESTRAL's intellectual property rights or those of its holders.

(c) Use the Sites and Services for illegal purposes or effects.

(d) Pay in full for the services or products requested from GESTRAL unless they cancel their request at least 24 hours in advance in writing through the available means, including but not limited to this platform.
